These Terms of Service ("Terms") govern your access to and use of https://zitrion.tech(the "Site"), our blog, contact forms, newsletter, social media accounts, and any related online services operated by Zitrion Techs ("Zitrion," "we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. About Zitrion

Zitrion is a data and technology solutions studio based in Nairobi, Kenya. Through our website and channels, we share information about our services — including analytics, business intelligence, workflow automation, data systems, and custom software platforms — publish educational content, and provide ways for prospective clients to get in touch.

These Terms apply to public use of our website and digital presence. Separate written agreements govern paid consulting, development, or implementation engagements once formally accepted by both parties.

We reserve the right to restrict or terminate access to the Site for conduct that violates these Terms or is otherwise harmful.

4. No professional relationship from browsing alone

Information on the Site — including blog posts, case studies, service descriptions, and general guidance — is provided for informational purposes. Submitting a contact form, subscribing to our newsletter, or communicating with us does not create a client, agency, partnership, or fiduciary relationship unless and until both parties enter into a separate written agreement.

Any timelines, pricing references, or capability descriptions on the Site are illustrative and non-binding unless confirmed in a formal proposal or contract.

5. User submissions

When you submit information through our contact form, newsletter signup, email, or social channels, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it.

Client work showcased in our portfolio remains subject to the intellectual property terms agreed with each client. Case study presentation on the Site does not grant you rights to underlying client deliverables.

Our blog publishes articles about data systems, engineering, product development, and related topics. While we aim for accuracy, content may become outdated as technology and business conditions change. Blog posts are not tailored professional advice for your specific situation.

When you interact with Zitrion on TikTok, Instagram, Facebook, or other social platforms, your use of those platforms is subject to the platform's terms of service and community guidelines in addition to these Terms.

We may remove, hide, or report interactions that are abusive, spammy, misleading, infringing, or otherwise inappropriate. We are not obligated to monitor all social interactions but reserve the right to do so.

10. Admin and restricted areas

Certain portions of our infrastructure, including admin dashboards for blog and lead management, are restricted to authorized Zitrion personnel. Unauthorized access attempts are prohibited and may result in legal action.

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranty regarding the accuracy, completeness, or reliability of any content.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZITRION AND ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zitrion and its founders, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If not resolved within thirty (30) days, disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, unless applicable law requires otherwise.

16. Changes to these Terms

We may modify these Terms at any time by posting an updated version on this page and revising the effective date above. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Site.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire agreement

For public use of the Site, these Terms together with our Privacy Policy constitute the entire agreement between you and Zitrion regarding the Site. They do not replace any separate signed contract for paid services.
